Sun Pharma Takes Unique Road To Victory Vs. J&J

Law360, New York (October 26, 2005, 12:00 AM ET) -- Taking a unique route to expediting a decision in a patent infringement lawsuit, India’s Sun Pharmaceuticals Inc. has won the right to make a generic version of Johnson & Johnson’s painkiller Ultracet.

J&J’s subsidiary Ortho-McNeil Pharmaceutical Inc. sued Sun's subsidiary Caraco Pharmaceutical Laboratories Ltd. in September 2004, in response to Caraco’s Abbreviated New Drug Application (ANDA) with the U.S. Food and Drug Administration. The suit was filed in the U.S. District Court for the Eastern District of Michigan.
