NY Top Court Takes Up Post-Judgment Policy Exclusion Bid

Law360, New York (April 25, 2013, 7:23 PM ET) -- New York's top court grappled Thursday with whether an insurer that refused to defend a lawyer in an underlying malpractice case should be able, after the lawyer lost a default judgment, to return to court and assert “business enterprise” policy exclusions related to the lawyer's bankrupt real estate concern.
