Fed. Circ. Ups Protection For Whistleblowers' Disclosures

Law360, New York (April 29, 2013, 6:06 PM EDT) -- The Federal Circuit stressed Friday that government whistleblowers are protected by federal law unless their disclosures are explicitly prohibited by another statute, reviving the case of an air marshal who was fired for leaking policy changes to a reporter.

According to the opinion, Robert MacLean was terminated after he told an MSNBC reporter that the Department of Homeland Security planned to remove all marshals from flights in and out of Las Vegas for a short period in 2003 — a change he thought endangered public safety....
