Regulators Can Review Miners' Health Records, 7th Circ. Says

Law360, New York (April 26, 2013, 5:22 PM ET) -- Federal regulators overseeing the safety of U.S. mines are allowed to review employee medical and personnel records and impose stiff fines against mine operators that refuse to hand over the information, the Seventh Circuit ruled Friday.

In a unanimous decision, the Seventh Circuit rejected appeals brought by mine operator Peabody Midwest Mining LLC, subsidiary Big Ridge Inc. and a group of miners who alleged the request for medical records by the U.S. Department of Labor's Mine Safety and Health Administration violated their right to privacy....
