Justices Urged To Eye Sanctions Rule For 'Baseless' IP Suits

Law360, New York (April 29, 2013, 7:30 PM ET) -- Blue Cross Blue Shield Association urged the U.S. Supreme Court Wednesday to review a Federal Circuit ruling that sanctions orders for "objectively baseless" patent suits are entitled to no deference on appeal, saying that standard will encourage dubious litigation.

The association filed an amicus brief supporting insurer Highmark Inc.'s March petition seeking to overturn an August ruling by the appeals court that negated part of a sanctions order against patent owner Allcare Health Management Systems Inc.
