3rd. Circ. Says Premises Exclusion Bars Injury Coverage

Law360, New York (April 30, 2013, 4:08 PM EDT) -- The Third Circuit held Friday that an insurer had no duty to cover a lawsuit against a Philadelphia-area newspaper distributor over an off-site injury, ruling that a location-related exclusion applied while also rejecting arguments to expand insurers' obligations for covering underlying settlements.

Overturning a lower court ruling, the appeals court freed American Western Home Insurance Co. from paying for the defense and settlement of an underlying personal injury suit against Donnelly Distribution Inc., a company that distributes newspapers, advertisements and other paper circulars.
