CVS Tells 5th Circ. Patient Info Suit Must Be Arbitrated

Law360, New York (April 30, 2013, 5:06 PM EDT) -- CVS Caremark Corp. on Monday urged the Fifth Circuit to uphold a Mississippi federal court order forcing arbitration in a class action brought by 23 retail pharmacies accusing CVS of luring customers away from its rivals using proprietary patient information.

CVS argues that the pharmacies have a contractual obligation under their provider agreements to arbitrate their claims, which are the latest of several actions accusing CVS of misappropriating patient and prescription data in order to push those patients into filling future prescriptions at its own pharmacies....
