Energy Co. Sues Town Over Plant Approval Dispute

Law360, New York (January 10, 2008, 12:00 AM EST) -- Laidlaw Energy & Environmental Inc. has filed a $10 million lawsuit against the town of Ellicottville, N.Y., alleging that the town illegally blocked its plans to adapt its co-generation facility to run on biomass fuel, the company announced Thursday.

The suit claims that Ellicottville acted improperly and that its decisions in regards to the energy company's attempts to secure the necessary approval to modify the facility were “arbitrary and capricious.”

Laidlaw demands a trial by jury, declaratory judgment that it is entitled to continue its co-generation...
