Viacom V. YouTube Provides Some Insight Into DMCA

YouTube. The court found that YouTube was protected under the safe harbor provisions of the Digital Millennium Copyright Act.[1] This decision — issued after a remand from the Second Circuit — gives new insight into how federal courts will apply the DMCA's Section 512(c) safe harbor provisions to online service providers (such as YouTube) whose websites contain user-generated content that may infringe upon the copyright of a third party....
