Fla. Justices Expand Magistrate Judge Role In Foreclosures

Law360, Miami (May 09, 2013, 6:01 PM ET) -- The Florida Supreme Court on Thursday approved amendments to the state's rules of civil procedure that will expand the use of general magistrate judges to help process the mortgage foreclosure cases currently clogging the court system.

The state high court adopted amendments to Florida Rule of Civil Procedure 1.490 proposed by the Trial Court Budget Commission that would authorize the referral of mortgage foreclosure cases to general magistrates based on implied consent of the parties involved, while still providing an opportunity for the parties to object,...
