ConAgra Loses NLRB Case Over Verbal Union Activity Warning

Law360, New York (May 10, 2013, 3:53 PM EDT) -- A National Labor Relations Board administrative law judge ruled Thursday that ConAgra Foods Inc. violated federal labor law by reprimanding an employee for discussing union activities on the clock and warning employees that union discussions are banned during shifts, saying such speech is protected.

Administrative Law Judge Arthur J. Amchan ordered the company to rescind the verbal warning it issued to the employee and revise a letter which warned employees at its Troy, Ohio, facility that union discussions during work time violate the company's solicitation policy,...
