Nonprofit Heads Can't Sue Under ADA, ADEA: 9th Circ.

Law360, New York (January 14, 2008, 12:00 AM EST) -- A federal appeals court has found that a fired executive director at a nonprofit media organization cannot bring an age and disability discrimination suit against the entity because he is not considered an employee under anti-discrimination laws.

In a decision handed down Monday, the U.S. Court of Appeals for the Ninth Circuit sided with a lower court’s decision that directors of a nonprofit organization are not employees under the Age Discrimination in Employment Act and the Americans with Disabilities Act.
