HHS OKs Unique Bifurcated ACA Exchange For Utah

Law360, New York (May 13, 2013, 4:46 PM ET) -- The U.S. Department of Health and Human Services has agreed to Utah’s proposed model for its Affordable Care Act-mandated health insurance exchange, allowing the state to run the small business portion while leaving individual insurance under HHS oversight, Utah Gov. Gary Herbert announced Friday.

According to the announcement, the state will continue to operate its existing exchange —  Avenue H, created before the ACA's 2010 passage — as the certified Small Business Health Options Program, or SHOP, exchange for the state, while HHS will be responsible...
