5th Circ. Upholds Dismissal Of Katrina Emissions Suit

Law360, New York (May 14, 2013, 7:33 PM EDT) -- The Fifth Circuit on Tuesday affirmed the dismissal of a proposed class action accusing Shell Oil Co. and other companies of strengthening Hurricane Katrina and causing property damage through their greenhouse gas emissions, ruling the allegations had already been decided.

The litigation has taken a twisting path through the court system. The plaintiffs, a group of Mississippi property owners, first sued the companies in 2005, claiming their emissions helped caused global warming, which intensified Hurricane Katrina, which damaged their property.
