Fla. Force-Placed Insurance Suits Can Proceed, Judge Says

Law360, Miami (May 16, 2013, 10:12 PM EDT) -- A Miami federal judge on Thursday refused to dismiss several putative class actions in Florida that claim a slew of major banks and insurance companies conspired to overcharge homeowners for force-placed insurance, also saying that the cases will move quickly. 

The cases pit homeowners who the lenders or mortgage servicers claim failed to voluntarily take out insurance required by their mortgages against some of the nation's largest banks — Bank of America NA, JPMorgan Chase NA, HSBC USA NA, Citibank NA and Wells Fargo NA —...
