Sens. Push ITC Against Import Bans Over Essential Patents

Law360, New York (May 22, 2013, 6:07 PM EDT) -- Sens. Mike Lee, R-Utah, and Amy Klobuchar, D-Minn., urged the U.S. International Trade Commission on Tuesday against allowing companies to use their standard-essential patents to block the import of rivals' products, saying that could undermine the standard-setting process.

Lee and Klobuchar, the ranking member and chair of the Senate's antitrust subcommittee, wrote to the ITC as it weighs Samsung Electronics Co. Ltd.'s bid to ban imports of certain iPhones and iPads amid a patent dispute with Apple Inc.
