DC Circ. Urged To Toss Challenge To OSHA Hazmat Regs

Law360, New York (May 23, 2013, 8:54 PM EDT) -- A union for Goodyear Tire & Rubber Co. employees on Tuesday urged the D.C. Circuit to deny an effort to overturn U.S. Occupational Safety and Health Administration rule revisions that say government-mandated hazardous materials warnings do not preempt personal injury suits.

OSHA's hazard communication standard underwent those amendments a year ago and they have come under attack by the American Tort Reform Association, which filed a petition for review of the new rules with the D.C. Circuit in May 2012.
