11th Circ. Lifts Bar On Fla. State Worker Drug Test Order

Law360, New York (May 29, 2013, 8:07 PM EDT) -- The Eleventh Circuit struck down an injunction Wednesday that blocked an executive order from Florida Gov. Rick Scott mandating random drug testing for around 85,000 state employees, but stopped short of giving its blessing to the testing policy and its “unprecedented scope.”

A three-judge appellate panel vacated an April 2012 order granting summary judgment to labor union American Federation of State, County and Municipal Employees Council 79, which sued claiming that Executive Order 11-58 ran afoul of the Fourth Amendment.
