Antitrust Group Wants Standard-Essential Patent Guidance

Law360, New York (May 30, 2013, 3:24 PM EDT) -- An antitrust think tank on Thursday called on U.S. competition regulators to issue enforcement guidelines that would force technical standard-setting organizations to establish stronger policies on the thorny issue of standard-essential patents.

The American Antitrust Institute said it had formally petitioned the U.S. Department of Justice and Federal Trade Commission to issue rules that would open up SSOs to antitrust liability if they don't adequately police patent holdup — the intentional misuse of standards-essential patents to net big royalties.
