NJ Senate Advances Crackdown On Trucker Misclassification

Law360, New York (May 30, 2013, 6:19 PM EDT) -- The New Jersey Senate on Thursday gave final legislative approval to a controversial, union-backed bill in New Jersey to establish a presumption that port and parcel delivery truck drivers are employees and not contractors unless companies can prove otherwise.

In a 21-17 vote, lawmakers approved the Truck Operator Independent Contractor Act, which sponsors argue would prevent companies in those industries from avoiding state contributions and employee benefit responsibilities by misclassifying drivers as independent contractors.
