Capital One Not Owed Privacy Suit Coverage, Insurer Says

Law360, New York (May 30, 2013, 5:03 PM EDT) -- CastlePoint National Insurance Co. hit Capital One Bank (USA) NA and a repossession company with a suit in Minnesota federal court Thursday, alleging it doesn’t have to cover the companies in an underlying class action claiming they misused private information to pursue car loan debtors.

According to the insurer, the underlying claims against Capital One and Minnesota Recovery Bureau Inc. aren’t covered under MRB’s commercial liability policy, which provides coverage for only specific types of alleged injury caused by the company.
