Title VII Bars Breast-Feeding Discrimination, 5th Circ. Says

Law360, New York (May 31, 2013, 3:22 PM ET) -- The Fifth Circuit revived a U.S. Equal Employment Opportunity Commission suit Thursday against a debt collector accused of terminating a worker after she asked to use a breast pump at work, holding that firing a woman because she was lactating constituted Title VII sex discrimination.

A three-judge appeals court panel struck down a February 2012 trial court decision that granted Houston Funding Corp. summary judgment and ruled that discharging a female employee because she was lactating or expressing milk did not amount to sex discrimination....
