NY High Court Takes Tobacco Medical Monitoring Appeal

Law360, New York (May 31, 2013, 3:52 PM EDT) -- New York's top court said Thursday it will consider whether smokers can bring a stand-alone medical monitoring claim against a tobacco company if they are not injured — and if so what elements and statute of limitations control such claims — after a federal court cited a lack of controlling precedent.

The New York State Court of Appeals will hear from attorneys representing both sides of a proposed class action brought by smokers who want Philip Morris USA Inc. to provide them with lung cancer screening....
