FECA Challenge Must Be Heard En Banc, DC Circ. Says

Law360, New York (May 31, 2013, 3:58 PM EDT) -- The D.C. Circuit on Friday remanded a constitutional challenge to the Federal Election Campaign Act’s provision prohibiting government contractors from contributing to political campaigns, advising a lower court to certify the case to an en banc court of appeals, as required by law.

A three-judge panel said it lacks jurisdiction to hear a case, which was brought by three individual federal contractors who say the statute is preventing them from donating to political candidates and parties, in violation of their constitutional rights.
