IRS Withholding $125M Owed In Abbott Case, Va. AG Says

Law360, New York (June 5, 2013, 3:44 PM EDT) -- Virginia’s attorney general said Wednesday that the federal government is refusing to release approximately $125 million owed to the state from a 2012 criminal Medicaid fraud case over off-label marketing and kickbacks claims related to Abbott Laboratories’ anti-seizure drug Depakote.

Last year, Abbott agreed to a $1.6 billion settlement resulting from its alleged illegal promotion of Depakote from 1998 to 2006 for behavioral disturbances in dementia patients and similar conduct from 2002 to 2006 for treatment of schizophrenia despite lack of U.S. Food and Drug Administration...
