Google, Amazon Back Fed. Circ.'s Claim Construction Ruling

Law360, New York (June 5, 2013, 6:12 PM EDT) -- Google Inc., Inc. and others on Tuesday backed the Federal Circuit's finding that claims construction rulings must be reviewed fresh on appeal, arguing that claims constructions are "purely legal" matters that warrant such review.

Google, Amazon, Hewlett Packard Co. and Yahoo Inc. argued in an amicus brief that claims constructions based on patent and litigation history involve the interpretation of legal language, and that this amounts to a legal matter that an appeals court should consider de novo.
