Retractable's Antitrust, Patent Claims Severed

Law360, New York (January 22, 2008, 12:00 AM EST) -- A federal judge has agreed to sever Retractable Technologies Inc.'s antitrust claims from the patent infringement claims it brought against rival medical-technology-maker Becton Dickinson and Co.

In an order issued Thursday, Judge David Folsom of the U.S. District Court for the Eastern District of Texas granted Becton's motion to split off a false advertising claim under the Lanham Act, an antitrust claim under the Sherman and Clayton acts, a claim under the Texas Antitrust Act and an unfair competition claim, and assign them a new case...
