Texas High Court OKs Tax Refund For Health Care Contract

Law360, Dallas (June 7, 2013, 5:41 PM EDT) -- The Supreme Court of Texas on Friday said insurance giant Health Care Services Corp. was rightly granted a refund of most of the sales tax it paid on goods and services it used to administer federal health insurance programs under the state’s sale-for-resale exemption.

The court unanimously held HCSC was rightly awarded a refund of some of the $5 million in sales taxes it had paid the state over a decade, except that it could not get a refund of taxes it paid on leased property...
