8th Circ. Junks Calif. Homeowners' Challenge To Uponor Deal

Law360, New York (June 7, 2013, 5:02 PM EDT) -- The Eighth Circuit refused Friday to derail a settlement in multidistrict litigation accusing Uponor Inc. of misleading consumers into buying defective plumbing systems, rejecting arguments by California class members that their interests were not being fairly represented.

A unanimous three-judge panel said Oscar Ortega and his fellow objectors could not overturn a Minnesota federal judge's class certification order simply because settlement negotiations failed to include a representative to advocate for the unique rights of California homeowners under state law.
