1st Circ. Nixes Fund Manager's Securities Offering Row

Law360, New York (June 11, 2013, 1:25 PM EDT) -- The First Circuit on Monday affirmed the dismissal of hedge fund manager Phillip Goldstein's long-running suit accusing a Massachusetts official of singling him out for securities law enforcement, ruling that Secretary of the Commonwealth William Galvin was protected by absolute prosecutorial immunity.

A three-judge panel unanimously upheld the 2012 dismissal of Goldstein's civil rights lawsuit against Galvin, who brought an administrative complaint against Goldstein and others in 2007 claiming they made an unregistered public securities offering via the Internet.
