Judge Ups Royalty Rates In $101M NuVasive Patent Verdict

Law360, Los Angeles (June 11, 2013, 10:39 PM EDT) -- A California judge on Monday ordered NuVasive Inc. to pay royalty rates between 3 and 6 percent higher than stipulated in a $101 million jury verdict for its post-verdict infringement of patents related to implants and devices used in spinal surgeries.

A jury found in September 2011 that Warsaw Orthopedic Inc., a unit of Minneapolis-based Medtronic Sofamor Danek USA Inc., had proved that several NuVasive products for minimally invasive spinal surgeries infringed the medical technology company's patents.
