Federal Circuit Erred In Union Carbide, RIM, Eolas: Bar Brief

Law360, New York (November 15, 2005, 12:00 AM EST) -- The Federal Circuit’s failure to interpret U.S. Code correctly in recent high-profile cases involving Research In Motion and Eolas led to a flawed ruling over the reach of process claims in Union Carbide Corp. v. Shell Oil, according to two national bar associations.

The American Intellectual Property Law Association (AIPLA) and the Federal Circuit Bar Association (FCBA) filed an amicus brief in the case that resulted in more than $150 million in damages against Shell for infringing three patents held by Dow Chemicals Inc.'s Union Carbide....
