Calif. Court Urged To End Injunction On 'On-Call' Pay Policy

Law360, Los Angeles (June 14, 2013, 7:55 PM EDT) -- CPS Security Solutions Inc. urged a California appeals court Friday to dissolve an injunction barring its “on-call” system for paying construction site guards who live in trailers on-site, arguing a lower court erred by finding the system illegal despite case law allowing sleep time to be excluded from pay.

At oral arguments before a three-judge state appellate panel, Howard M. Knee, a lawyer representing CPS, argued that his client's wage policies were twice upheld by California's Labor Commissioner since 2003.
