No Race Bias In BP Bid Award: Appeals Court

Law360, New York (January 23, 2008, 12:00 AM EST) -- BP Plc did not discriminate on the basis of race in rejecting a bid from DAG Petroleum Suppliers LLC to buy a number of gas stations, a federal appeals court has ruled.

The U.S. Court of Appeals for the Fourth Circuit tossed DAG's suit on Wednesday, finding that BP had presented enough evidence to show that it rejected DAG's proposal because competing bids were more economically and strategically appealing.
