Fed. Circ. Finding On Appeals Will Hasten Patent Rulings

Law360, New York (June 14, 2013, 9:46 PM EDT) -- The Federal Circuit's en banc ruling Friday that it can hear appeals of patent infringement findings even when issues of damages and willfulness are unresolved could lead more judges to streamline cases by bifurcating the issues and deciding liability first, attorneys say.

In a divided opinion, the court held that Pylon Manufacturing Corp. could file an interlocutory appeal of a lower court's ruling that it had infringed Robert Bosch LLC's windshield wiper patents, even though a separate trial on damages and willfulness had not yet taken...
