1st Circ. Sinks Aviation Fuel Seller's Antitrust Case

Law360, Miami (June 14, 2013, 10:38 PM EDT) -- The First Circuit on Friday refused to revive a suit brought by a Puerto Rican company that sells aviation fuel, upholding the dismissal of its claims that the Puerto Rico Ports Authority and a rival company engaged in an anti-competitive scheme that interfered with its business.

The appeals panel said Diaz Aviation Corp. and founder Sixto Diaz-Saldana hadn't left the judges with a “definite and firm conviction that a mistake has been committed.”
