7th Circ. Nixes Ex-Navistar Workers’ Suit Over Nonunion Hires

Law360, Los Angeles (June 18, 2013, 6:27 PM EDT) -- A group of former Navistar Inc. workers lost their bid Tuesday to revive a suit alleging the engine manufacturer fired them in favor of nonunion subcontractors, when the Seventh Circuit ruled their required companion claims against their union were insufficient.

Former workers at Navistar engine plant in Indianapolis brought the action against the company under the Labor Management Relations Act. They said Navistar broke the terms of a collective bargaining agreement by hiring third-party employees and not rehiring the union employees when new work became available....
