Aetna Dodges Class Action Alleging Coercion Of Doctors

Law360, Los Angeles (June 19, 2013, 10:42 PM EDT) -- Aetna Health Inc. on Wednesday escaped a putative class action alleging it illegally removes doctors from its network if they refer patients to out-of-network medical providers, when a California judge ruled the claims are barred by the at-will termination clause in Aetna's provider contracts.

Aetna's victory may be short-lived because Los Angeles Superior Court Judge Elihu M. Berle gave named plaintiff Dr. Marc Kerner 30 days to amend his complaint. He had failed to attach his provider contract to the third amended complaint he filed in...
