Apotex Gets $5M In Ear-Drop Patent Suit

Law360, New York (January 25, 2008, 12:00 AM EST) -- Apotex Corp. will collect $5 million in wrongful injunction damages after successfully defending an infringement case brought by Daiichi Sanko Co. Ltd. over a patent covering antibacterial ear medicine.

Judge Susan D. Wigenton of the U.S. District Court for the District of New Jersey on Thursday ordered the release of Daiichi’s $5 million cash security to Apotex, but refused to award the Canadian generics maker additional damages or interest.
