AEX Can't Beat Driver Employment Status Suit

Law360, Philadelphia (June 24, 2013, 4:40 PM EDT) -- A Pennsylvania federal judge refused to grant summary judgment to American Eagle Express Inc. on Monday in a case accusing the courier of illegally denying overtime pay to drivers it misclassified as independent contractors.

In an order that moves the case closer to a potential trial in July, U.S. District Court Judge Juan Sanchez shot down arguments from AEX that the workers could not be considered direct employees of the company based on federally mandated policies instituted companywide.
