Enviros Ask Feds To Take Over W.Va. Mining Enforcement

Law360, New York (June 24, 2013, 7:24 PM EDT) -- Earthjustice, Sierra Club and 16 other groups on Monday asked federal regulators to seize mining enforcement and oversight duties from the West Virginia Department of Environmental Protection, saying state officials are failing to hold operators accountable for permit violations.

Lodging an administrative law petition with the federal Office of Surface Mine Reclamation and Enforcement, the groups said the DEP is chronically understaffed and either unable or unwilling to make permit-holders pay for environmental damage.
