Transit Group Seeks To Shut Down ArrivalStar IP Suits

Law360, New York (June 26, 2013, 6:20 PM EDT) -- Public transportation agencies cannot be sued for patent infringement, an advocacy group said in a suit filed Tuesday that aims to invalidate nonpracticing entity ArrivalStar SA's vehicle-tracking patents, which it has asserted against several transit authorities.

The suit by the American Public Transportation Association, which represents 300 public transit agencies nationwide, said that the 11th Amendment of the U.S. Constitution, which gives states sovereign immunity from being sued, bars ArrivalStar's infringement suits against state transit authorities.
