Broker Blamed For Coverage Gap At NJ Sewage Facility

Law360, New York (June 27, 2013, 5:57 PM EDT) -- East Brunswick, N.J.-based Tomar Construction LLC has sued its insurance agent for allegedly failing to secure proper coverage for a Passaic Valley Sewerage Commission project and exposing the company to more than $1 million in Superstorm Sandy damages at the public wastewater treatment facility.

In yet another example of brokers shouldering Sandy-related claims in the state, Tomar contends in a June 24 complaint in Middlesex County Superior Court that Totowa, N.J.-based C&H Agency should be found negligent and in breach of its contract and fiduciary duties...
