7th, 11th Circs. Rule ACA Covers Black Lung Claims

Law360, Los Angeles (June 27, 2013, 8:11 PM ET) -- The Seventh and Eleventh circuits ruled in separate cases Thursday that the Affordable Care Act entitles a miner and another miner's widow to benefits related to black lung disease, denying employers' arguments that their claims fell outside the scope of the 2010 health care reform.

“The Affordable Care Act eliminated the need for survivors who can meet its requirements to prove that their associated miners died due to pneumoconiosis,” or black lung, the Eleventh Circuit's opinion said.
