Fla. Lawyers Challenge New Medical Malpractice Law

Law360, New York (July 1, 2013, 7:39 PM EDT) -- Attorneys in Florida on Monday filed lawsuits across the state in a coordinated attack on a new medical malpractice law that allows doctors named as defendants to disclose patient information under some circumstances.

Three federal lawsuits filed on behalf of both patients and law firms allege the law violates the Health Insurance Portability and Accountability Act, and two state lawsuits make the HIPAA claims as well as alleging the bill encroaches on the Florida Supreme Court’s authority to govern pre-suit discovery in medical malpractice cases and...
