VW Can't Shake Willful Infringement Claim In Shocks Suit

Law360, New York (July 2, 2013, 8:09 PM EDT) -- A Delaware federal judge on Tuesday refused to dismiss Cloud Farm Associates LP's allegation that Volkswagen Group of America Inc. willfully infringed a patent for the electronic tilt-control systems used in its vehicles, ruling that the automaker's alleged disregard for a notice about the patent supported the claim.

District Judge Leonard Stark said Cloud Farm’s allegation that Volkswagen blew off an August 1999 letter about U.S. Patent Number 5,437,354 that urged the automaker to license the covered technology was enough to back up a willful infringement claim....
