Generics Makers Escape NJ Accutane Mass Tort

Law360, New York (July 2, 2013, 8:19 PM EDT) -- A New Jersey state judge on Friday dismissed all claims against manufacturers of generic Accutane in litigation claiming the acne drug causes irritable bowel syndrome, ruling that the allegations, including design defect and negligence claims, are preempted by federal law.

In granting a dismissal motion from Barr Laboratories Inc., Mylan Pharmaceuticals Inc. and Ranbaxy Laboratories Ltd., Judge Carol Higbee held the plaintiffs cannot evade the U.S. Supreme Court's Pliva Inc. v.
