First Accelerated ITC Review Shuts Down Lamina Patent Case

Law360, New York (July 8, 2013, 3:43 PM EDT) -- In the first ruling under a new U.S. International Trade Commission program to resolve key issues early in patent cases, an ITC judge ruled Friday that Lamina Packaging Innovations LLC failed to meet the domestic industry requirement in a suit against Hasbro Inc. and others.

If it is affirmed by the full ITC, Administrative Law Judge Theodore R. Essex's ruling will effectively shut down Lamina's suit, filed in February, which alleges that companies in industries ranging from liquor to headphones infringe its packaging patents.
