Kimberly-Clark Diaper Patents Not Obvious, Judge Rules

Law360, New York (July 08, 2013, 7:13 PM ET) -- A Pennsylvania federal judge on Monday denied First Quality Baby Products LLC’s bid to invalidate two Kimberly-Clark Worldwide Inc. diaper patents, ruling they weren’t obvious based on the available evidence.

According to U.S. District Judge William W. Caldwell, First Quality had failed to show that the two patents, covering absorbency technology used in disposable diapers, training pants and adult incontinence products, were anticipated by prior art and therefore obvious.
