Fla. Keys Properties Weren't Taken By County, Court Rules

Law360, Miami (July 10, 2013, 7:11 PM ET) -- A Florida appeals court on Wednesday affirmed a judgment against Florida Keys landowners who claimed Monroe County's increasingly strict development regulations had effected a constitutional taking of their properties.

In the landowners' fifth appearance before Florida's Third District Court of Appeal, a panel of appeals judges affirmed the trial court's dismissal of the landowners' claims against the county and the state, noting that, with the exception of one property owner, none of the landowners had ever taken any steps to develop their properties.
